1. Trading Terms

All services provided by Noble Freight Services Pty Ltd (ACN noted on quotations) are subject to the standard trading conditions of the International Forwarders and Customs Brokers Association of Australia (IFCBAA) of which we are a Member. A copy of the IFCBAA Standard Trading Conditions is available on request or via the IFCBAA website at www.ifcbaa.com.

2. Quotations

All quotations are based on information provided at the time of enquiry and are valid for the period stated on the quotation, or 14 days if no period is stated. Quotations are subject to current rates, surcharges, exchange rates, fuel costs and carrier availability and may be revised if any of these change between quotation and shipment.

3. Insurance

Insurance of cargo is the responsibility of the shipper / consignee. We do not insure cargo unless specifically instructed to do so in writing and confirmed by us in writing. Cover where arranged is subject to the terms, conditions and exclusions of the relevant insurance policy.

4. Limitation of Liability

Our liability is strictly limited as set out in the IFCBAA Standard Trading Conditions. Where international conventions apply (such as the Warsaw or Montreal Conventions for air, the Hague-Visby Rules for sea, or the CMR Convention for road), our liability is further limited as provided by those conventions.

5. Payment Terms

Unless otherwise agreed in writing, all invoices are payable within 14 days of invoice date. Overdue accounts may incur interest and recovery costs. We reserve the right to exercise a general lien over goods in our possession for unpaid charges.

6. Dangerous Goods

Dangerous Goods must be declared at the time of booking and accompanied by a current Safety Data Sheet (SDS) and a Dangerous Goods Declaration. The shipper warrants that DG cargo is properly classified, packed, marked, labelled and documented in accordance with IATA (air) or IMDG (sea) regulations.

7. Cargo Condition & Description

The shipper is responsible for the accuracy of all information provided, including description, weight, dimensions, value and packing details. Penalties or additional charges arising from incorrect information are for the shipper's account.

8. Force Majeure

We are not liable for any delay or non-performance caused by events outside our reasonable control, including but not limited to weather, port congestion, industrial action, government action, pandemic, war or carrier failure.

9. Customs & Biosecurity

Where we act as customs broker we do so as your agent. You warrant that all information supplied is true and accurate, and you authorise us to lodge entries and communicate with the ABF, DAFF and other authorities on your behalf. You remain responsible for the payment of all duties, GST and government charges.

10. Governing Law

These terms are governed by the laws of Western Australia and the parties submit to the non-exclusive jurisdiction of the courts of Western Australia.
